Bug in detection of front-window-does-not-exist?

I have a macro that activates Finder, and then, if it finds there's no window open in Finder, opens a specific window.

After confirming Finder is active, I have this action determine whether there's no window to decide whether to open one:

It appears to determine there is a window (with name being null) even if there is none!

As a workaround, I changed it to test for blank window name, which works:

So this is an FYI (unless there's something I'm missing in which case educate me  )

The Finder always has a window open, namely the desktop, which is actually a full size immovable window.
